Terms of Service
These Terms of Service ("Terms") govern your access to and use of iyogau.com, the iYogaU journaling platform, and any course or program delivered by iYogaU (collectively, the "Services"). The Services are operated by Ali Karimi, doing business as iYogaU ("iYogaU," "we," "us," or "our"). By using the Services or enrolling in a program, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to enroll in iYogaU programs. By enrolling, you represent that you have the legal capacity to enter into a binding contract in the jurisdiction where you reside. If you are enrolling on behalf of an organization, you represent that you have authority to bind that organization.
2. Enrollment and account
Enrollment is by application. We may decline an application at our discretion if a program is not a good fit for the applicant. When you create an account on the journaling platform, you agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized access.
3. Tuition, billing, and currency
Tuition for the Inner Transformation Course is USD 5,000 unless a different amount is communicated to you in writing at the time of enrollment. The website displays the price in your local currency using a daily-refreshed exchange rate; the local-currency figure is informational only, and the actual charge is taken in USD (or in another currency we agree to in writing). All payments are due before your program start date unless we have agreed to a payment plan in writing.
You are responsible for any taxes, duties, or fees that apply in your jurisdiction.
4. Cancellation and refund policy
- 14-day cooling-off period: if you cancel within 14 days of enrollment and before your program has started, you receive a full refund less any third-party processing fees.
- Before the program starts (after 14 days): 50% refund.
- During Level 1 (first 21 days): 25% refund if cancelled within the first 7 days of Level 1; no refund after that.
- During Level 2 or Level 3: no refund. We will, in our discretion, defer your enrollment to a future cohort if extenuating circumstances arise.
- Medical exception: if a licensed physician advises you to discontinue physical practice for medical reasons, contact us with written documentation. We will work with you in good faith on a deferral, partial refund, or alternative arrangement.
To request a cancellation, email hello@iyogau.com. The effective cancellation date is the date we receive your written request. Refunds are issued by the original payment method within 30 days of approval.
5. Acceptable conduct
While using the Services, you agree not to:
- Share your account credentials or program access with any other person.
- Record, copy, redistribute, or republish course materials, recordings, or live sessions without our prior written consent.
- Reverse engineer or attempt to derive the source code of the journaling platform.
- Harass, threaten, or harm other practitioners or staff.
- Use the Services for any unlawful, fraudulent, or harmful purpose.
6. Intellectual property
All course content — written materials, recorded sessions, journaling prompts, the iYogaU name, the iYogaU logo, and the design of this website — is owned by iYogaU and protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the course content solely for your personal, non-commercial study during your enrolled program.
You may not reproduce, distribute, prepare derivative works of, publicly display, or publicly perform the course content without our prior written consent.
7. Your content and journal entries
You retain ownership of journal entries and other content you submit to the Services ("Your Content"). By submitting Your Content, you grant iYogaU a limited, non-exclusive, royalty-free license to store, display, and review Your Content for the sole purpose of delivering the program and providing mentorship feedback to you.
We will not publish Your Content publicly, share it with third parties, or use it to train artificial intelligence models. We may, with your separate written consent, anonymize and adapt portions of Your Content for educational examples or testimonials.
8. Health, fitness, and assumption of risk
Yoga is a physical practice. By enrolling, you acknowledge and agree to the matters set out in our Health Disclaimer & Liability Waiver, which is incorporated by reference into these Terms. In short:
- You are physically able to participate or have consulted a qualified physician before enrolling.
- iYogaU programs are educational and spiritual in nature, not medical advice.
- You assume the inherent risks of physical practice, including risk of injury.
- You agree to inform your instructor of any condition or limitation that may affect your practice.
9. Disclaimers
The Services are provided "AS IS" and "AS AVAILABLE". To the fullest extent permitted by applicable law, iYogaU disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted access. iYogaU does not warrant that the Services will produce any specific spiritual, emotional, or physical outcome.
10. Limitation of liability
To the fullest extent permitted by applicable law, iYogaU's total cumulative liability for any claim arising out of or related to these Terms or the Services will not exceed the amount you actually paid to iYogaU in the twelve (12) months preceding the event giving rise to the claim.
iYogaU will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, even if advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the smallest extent permitted by law.
11. Indemnification
You agree to indemnify and hold iYogaU and its operators harmless from any third-party claim arising out of (a) your breach of these Terms, (b) your misuse of the Services, or (c) your violation of any law or third-party right. iYogaU may control the defense of any matter for which you are obligated to indemnify, and you agree to cooperate.
12. Termination
We may suspend or terminate your access to the Services immediately if you materially breach these Terms, engage in conduct harmful to other practitioners, or fail to pay tuition when due. The sections that by their nature should survive termination — including intellectual property, disclaimers, liability limits, indemnification, and dispute resolution — will survive.
13. Governing law and disputes
For U.S. residents
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Services that cannot be resolved through good-faith negotiation will be resolved by binding individual arbitration administered by JAMS in Santa Clara County, California, under JAMS's Comprehensive Arbitration Rules and Procedures, except for claims that may be brought in small-claims court. You and iYogaU each waive the right to a jury trial and the right to participate in a class or representative action. An arbitrator may award the same individual remedies a court could award. Either party may seek injunctive relief in court for misuse of intellectual property.
You may opt out of this arbitration agreement by emailing hello@iyogau.com with the subject "Arbitration opt-out" within 30 days of first agreeing to these Terms.
For Korea residents
If you reside in South Korea, these Terms are governed by Korean law and disputes will be resolved by the Seoul Central District Court, without prejudice to your statutory consumer rights.
For China residents
If you reside in mainland China, these Terms are governed by the laws of the People's Republic of China and disputes will be resolved by the Shanghai International Economic and Trade Arbitration Commission (Shanghai International Arbitration Center), without prejudice to your mandatory consumer rights.
For all others
These Terms are governed by the laws of the State of California and disputes will be resolved by JAMS arbitration as described above, except where mandatory local law gives you the right to bring claims in your country of residence.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. For material changes, we will provide at least 30 days' advance notice by email or by a prominent notice on the website. Continuing to use the Services after the effective date of a revision means you accept the revised Terms.
